Statement on David LeVan and co-investors appealing the PGCB decision to the PA
Supreme Court:

We are sad to see Mr. LeVan and Lashinger chasing
their losses.  In six years of trying LeVan has never received a single vote
from the PA Gaming Control Board (2006 and 2011) or in his other attempts before
the PA Harness Racing Commission (2007 or 2008) for a casino near
Gettysburg. This PA Supreme Court appeal is a collossal waste of time and money
for the investors, the state, the taxpayers and our entire community. Because of
these investors' irrational obsession, our community and our nation may be
dragged through another several years of conflict, adding a sour note to the
150th anniversary of the Battle of Gettysburg.

Others think possibly LeVan believes this move is somehow positioning him to get the sole
remaining Cat 3 license in 2017. I don't know HOW it postions him but maybe there is a way it does.

In any circumstance, if he had a good case he wouldn't have needed sucha  scattershot approach, throwing everything into the appeal. A good case would be focused.

The only people who will benefit from this appeal are the owners of the Meadows, who feel that the Nemacolin casino will eat into their profits. Since Dave LaTorre is PR spokesman for both Mason-Dixon and the Meadows, there may be an unknown connection behind the appeal. Are the Meadows owners paying for it in order to get a year or two of marketing without the competition?

I'd like to think LeVan is doing this for $$$ because otherwise it just looks irrational.
