Opposition to a proposed casino 1/2 mile from the Gettysburg NMP
On 4/20/12 the PA State Supreme Court upheld the PA Gaming Control Board selection of Nemacolin for a resort casino license, thus rejecting the lawsuit by Gettysburg Casino investors Mason-Dixon, who wanted to place a resort casino at the Eisenhower Inn and Conference Center located just 1/2 mile from the boundary of the Gettysburg National Military Park.
David LeVan has been attempting to bring a casino to Gettysburg since 2005. None of his several proposals have ever received a single yes vote from the PA Gaming Control Board or the PA Harness Racing Commission. His public proposals were opposed nationwide and the Gaming Control Board was flooded with thousands of letters and petitions opposing the ill-conceived project.
Despite so much condemnation, Mason Dixon Casino still sued the PA Gaming Control Board, asserting bias in their choice of an established up-scale resort in Western PA over a run-down hotel next to one of America's most valued national heritage sites.
LeVan's Remaining Lawsuits:
This ended one of three lawsuits that Gettysburg investor David LeVan is stuck in. With the Mason-Dixon Supreme Court decision resolved, LeVan has only three lawsuits left.
He sued partner Joseph Lashinger to be released from his contract with Mason-Dixon, still to be decided in Adams County. Lashinger counter-sued to keep him attached to the failed enterprise, still to be decided in Philadelphia Courts. Then the Eisenhower Inn sued Mason-Dixon because LeVan and Lashinger failed to pay the hotel the contracted fee for failing to follow thru on the purchase of the hotel. The hotel lost considerable business because of their association with the idea of a casino so close to hallowed ground.
LeVan's reasons for suing to be released from his contract are because he wants to be free to pursue any future license opportunities. Currently the earliest possible license availability will be in 2017, just five years from now. Then the legislature has an opportunity to release another resort casino license. Informed sources tell our friends that his preferred location is the Links Golf Club community, about two miles from the Gettysburg National Military Park.
